Law360 recently featured an article focused on Professor David Hyman's recent study, "Medical Malpractice Litigation and the Market for PlaintiffSide Representation."
The study "examined a decade’s worth of medical malpractice data submitted to Illinois insurance regulators and found that of the more than 1,300 firms handling medical malpractice cases, just 22 “firsttier” plaintiffs firms accounted for 19 percent of all cases and a whopping 45 percent of total recoveries of $3.3 billion (Law360)." The study was co-authored by by Professors Bernard Black and Charles Silver of the University of Texas School of Law and Professor Mohammad Hossein Rahmati of Sharif University of Technology.
Hyman tells Law360: “The short answer is that it makes a big difference to have a lawyer and even a bigger difference who your lawyer is. You don't want someone who hasn’t been to their first rodeo. You want someone who has handled a lot of cases and can signal to the insurers on the other side that the case has merit.”
