blog postsFLSA UpdateShare on FacebookTweetEmailWhat is FLSA? The Fair Labor Standards Act (FLSA) is the federal act that governs pay and the classification of positions eligible for overtime. A recently announced change to FLSA means that starting December 1, 2016, employers will be required to pay certain employees overtime for hours worked above the designated full-time work week. Like all employers in the United States, the University of Illinois at Urbana-Champaign must comply with this federally mandated regulation. While this new law requires a different way of tracking time worked, it in no way diminishes the standing of any affected employee. It simply ensures that affected employees are compensated for overtime work, which is more than 40 hours per week for academic professionals and more than 37.5 hours per week for civil service employees. This site is provides information for affected employees and unit HR/business managers on what the new regulations mean and their roles in fulfilling the requirements. Court Injunction (11/22/16) Earlier this fall, the university advised certain employees that they would be receiving salary increases or would become eligible for overtime in response to changes to the Fair Labor Standards Act. Those changes were to become effective on December 1. A federal court issued an injunction yesterday stopping, at least temporarily, the nationwide implementation of those changes to the FLSA. Because of that, we are suspending, effective immediately, the announced salary increases and the changes in overtime eligibility while we consider the court’s determination and the impact that it has on our employees. We will continue to monitor this developing situation and keep you informed as we obtain additional information. Urbana-Champaign Campus Response (12/5/16) Over the past week, there has been considerable consultation with Legal Counsel, the President and others at the System level, UIC and UIS, as well as time spent learning how our peers are reacting to the federal injunction. As a result of those efforts, and after significant consideration of multiple factors, President Killeen has decided that the University of Illinois System will proceed with planned increases for academic and civil service staff. After consultation with many stakeholders, our campus will also move forward with the planned increases for our Postdoctoral Research Associates. Meanwhile, those employees who had been slated to become overtime eligible will remain exempt from overtime until there is clarity on what changes will ultimately be implemented for the Fair Labor Standards Act.
